Types of Workers' Compensation Benefits You Can Receive

Fighting for the rights of injured workers in Iowa

Workers injured on the job in Iowa are entitled to workers' compensation benefits. But the benefits they are eligible to receive depend on their particular situation. Workers' compensation attorney Paul McAndrew of Paul McAndrew Law Firm, PLLC helps injured workers navigate the claims process to get the benefits they deserve.

Types of workers' compensation benefits available to injured workers include:

  • Medical Benefits  - This includes the cost of all reasonable and necessary medical care for a work-related injury. It also includes necessary transportation expenses. Mileage is paid at a rate set by the state of Iowa.
  • Temporary Total Disability (TTD) - This provides partial wages for workers who have injuries or an illness that leaves them temporarily unable to work. Payments begin on the fourth day of disability.
  • Temporary Partial Disability (TPD) - This provides partial wages for workers who have injuries or illness that allow them to work, but at a lower-paying job. This benefit pays two thirds of the difference in pay.
  • Permanent Total Disability (PTD) - This benefit is for workers who have injuries or an illness that prevents them from working at all. It is payable for the rest of the worker's life.
  • Permanent Partial Disability (PPD) - This benefit is for workers who are able to return to work, but who have permanently lost some function as a result of their injury. It is payable for a maximum of 500 weeks.
  • Vocational Rehabilitation Benefits - Workers who have injuries or an illness that prevents them from returning to their previous job are eligible for these benefits. The Iowa Division of Vocational Rehabilitation Services (DVRS) provides injured workers with assistance in preparing for, obtaining and maintaining new employment.
  • Death Benefits - This benefit is payable to certain surviving family members of a worker who was killed in a workplace accident.

While injured workers are eligible for these benefits, actually getting them can be a challenge. Iowa's workers' compensation system favors employers and insurance companies, who consistently try to pay injured workers as little as possible. They count on injured workers not being familiar with the laws and not challenging the decision on their claims.

That's why you need an experienced workers' compensation attorney to fight for you. Attorney Paul McAndrew knows the tactics employers and insurance companies use to deny benefits for your work injury. And he knows how to build a strong case for benefits that can't be ignored. He gets results for clients by whatever means necessary - negotiation, appeals and hearings at the Iowa Division of Workers' Compensation, and court proceedings.
